D. Nutrition Counselling Services under this Agreement will begin on the date Client signs this agreement.
This Agreement automatically renews in conjunction with the membership option selected. above. Membership payments will be processed on renewal dates. Client understands that upon signing this Agreement, Client is not entitled to any refund of any part of the membership dues unless otherwise provided for in this Agreement. Client also understands that Personal Training sessions have a thirty (30) day expiration date and Client will not be refunded or credited for unused sessions, and there is no roll-over of unused sessions.

Client may cancel this Agreement at any time by providing written notice to Health Club via electronic mail (email) sent to the email address listed above. Memberships require a fourteen (14) day notice of cancellation unless otherwise provided for in this Agreement. Any regular payments scheduled within the cancellation window will be processed. Health Club may cancel this Agreement at any time for any reason. If, during his/her membership, Client becomes disabled in a manner that affects his/her capacity to use or enjoy the Health Club’s facilities, Client may cancel his/her membership with no further payments and a prorated portion of any amount prepaid for his/her thirty (30) days will be refunded to Client.
Client is asked to provide the Health Club verification of his/her disability from a physician and Client must request the refund via email. If, during his/her membership, Client dies, his/her estate representative may cancel his/her membership with no further payments and a prorated portion of any amount prepaid for his/her thirty (30) days will be refunded to Client’s estate. His/her representative must notify the Health Club of the death and request the refund via email. If, during his/her membership, (a) Client moves more than eight (8) miles from his/her current location, (b) Client moves more than thirty (30) miles from the Health Club, (c) the Health Club relocates thirty (30) miles or more away from Client, (d) or the Health Club closes, and the Health Club does not have a substantially similar facility that would accept Client’s obligation under this Agreement located within thirty (30) miles of Client, Client may cancel his/her membership with no further payments and a prorated portion of any amount prepaid for his/her thirty (30) days will be refunded to Client.
Client is asked to provide the Health Club with proof of his/her new residence and Client must request the refund via email.
Clients who elect twenty-eight (28) day membership billing cycles may hold an automatic payment one (1) time per calendar year for twenty-eight (28) days. To do this, the Health Club requires Client to send written notice at least seven (7) days in advance of Client’s next billing date. Written notice must be sent to the email listed above. No other form of hold request will be accepted. Failure to notify Health Club of the hold seven (7) days in advance of the Client’s next billing date will result in no hold and client will be automatically charged as set forth in this Agreement.

At the end of Client’s hold, payments will automatically begin again. A fee of $35 will be assessed for the membership hold. Client may not cancel a membership while on hold. If Client wishes to cancel a membership while on hold, the hold will be ended, and Client’s fourteen (14) day notice requirement will begin as set forth in this Agreement. Special arrangements, repairs, and maintenance may make it necessary for the Health Club to restrict use of or close. Fees will not be reduced or suspended during the time when the facility is not available. Health Club reserves the right to increase membership rates annually with 28 days’ notice to Client.
